Rules

I. General provisions

1. ekuva.lt. e-shop is owned by UAB "Ekuva": company code 300008384, address Šilutės pl.56, Klaipėda, phone +370 616 40002. The rules of the online shop (hereinafter - the Shop) (hereinafter - the Rules) shall apply to the Customer when placing an order in the e-ekuva.lt Shop.

2. ekuva.lt has the right to adjust the Rules of the Shop. The Rules shall apply to all Customers ordering in the Shop.

3. The Customer is obliged to familiarize himself with the Rules of the Shop before placing an order. In all cases, the Customer shall be deemed to have read and accepted the Terms and Conditions upon final placement of the order.

 4. The Shop shall not be liable for damages (material or moral) in cases where problems have been caused to the Customer without taking into account the information in the Rules which is publicly available on this page.

II. Privacy Policy

1. In order to order goods from the Shop, the Customer must register by entering all the information provided in the registration form. All the mandatory fields checked are necessary for the proper execution of the order. The Shop confirms that the fact of registration does not imply that the Customer will be sent information messages other than those necessary for the order and delivery of goods. If the Customer wishes to receive information messages from the Shop, he/she shall be given the opportunity to choose to receive such messages.

2. When ordering goods, the Customer shall provide the following personal data of the Customer: name; surname; address to which the goods will be delivered; telephone number; other data necessary for delivery. The Shop confirms that such data will only be used for the purpose of ordering and delivering the goods. The Shop undertakes not to disclose such information to third parties, except for the Shop's partners providing delivery or other services related to the placement or execution of the Customer's order. Any other exceptions to the disclosure of the Customer's personal information to third parties shall in all cases be agreed with the Customer.In all other cases, the Customer's personal data may only be disclosed to third parties in the cases provided for by the legislation of the Republic of Lithuania.

3. When registering in the Shop and ordering goods, the Customer undertakes to protect and not to disclose his/her login data to anyone. At the same time, the Customer confirms that he/she is of legal age and has the right to order goods from the Shop. In the event that the Customer discloses his/her login details, the Shop shall be exempt from any liability in this respect.

4. By reading the Terms and Conditions, the Customer acknowledges that he/she is aware that cookies (files sent from a web server) will be placed on his/her computer when browsing the Shop.

5. The Shop confirms that it strives to use the most advanced technologies to protect the personal data of Customers.

III. Order procedure and conditions

1. The Customer shall visit the Shop's website and select the goods he/she likes. On the basis of his/her choice, a shopping cart is formed.

2. Once the shopping cart has been created, the Customer (if he/she has not yet registered and logged in to the system) shall enter the data necessary for the delivery of the selected goods: his/her name, surname, address to which the goods will be delivered, telephone number and any additional information that may be relevant for the delivery of the ordered goods. The Shop confirms that the data provided by the Customer will be used exclusively for the purposes of the sale and delivery of the goods, in compliance with the requirements of the legislation of the Republic of Lithuania for the protection of personal data.

3. The Customer shall next select one of the available payment methods in the Shop. The delivery method and the price of the goods may be selected at the same time.

4. In the last step, all the data provided by the Customer is generated, before confirming which the Customer must make sure that the data provided is correct and corresponds to his/her preferences. The Customer shall have the opportunity to correct errors, if any, before the order is dispatched. In the event that the Customer is not familiar with the Terms and Conditions of the Shop before selecting the goods, he/she must do so before confirming his/her order and the data contained therein, otherwise the Customer will be deemed to be familiar with the Terms and Conditions.

5. Once the Customer has confirmed the order, the Shop receives all the information about it. The order shall be deemed to have been placed from the moment it is received by the Shop. At the same time, a contract shall be deemed to have been concluded between the Customer and the Shop. However, such contract shall only be deemed to be enforceable from the moment that the Shop receives confirmation from the Customer's chosen payment method of payment for the goods.

6. Once the Customer has placed an order, the Shop's system automatically sends the Customer an e-mail indicating the goods ordered and the Customer's details.

7. Upon notification that the Customer has made a payment order for the order placed, the Shop undertakes to fulfil the order.

8. The order placed by the Customer shall be stored in the Shop's database in accordance with the requirements of the applicable legislation of the Republic of Lithuania regarding the retention period of such data.

9. In all cases, the Customer shall be deemed to have read and unconditionally accepted all the Terms and Conditions of the Shop, as well as all other terms and conditions attached to the order, by placing the order.

10. The Contract shall be concluded and executed in the Lithuanian language.

IV. Warranties and pricing of goods

1. The characteristics of each item in the Shop shall be indicated generally for each item.

2. The Shop specifies and the Customer acknowledges that he/she is aware that the colour, shape or other parameters of the goods displayed in the Shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used.

3. The Customer agrees that when he/she places an order electronically in the Shop, he/she undertakes to pay for the goods at the price indicated in the order.

4. The prices in the Shop and on the order are in Euros.

5. The Shop sells the goods in accordance with the terms of the order. In the event that the goods handed over to the Customer do not comply with certain requirements of the order, the Customer agrees to first immediately notify the Shop in writing by e-mail or telephone, and the Shop undertakes to take all steps to remedy the existing defects, if such defects are caused by the fault of the Shop or of any third parties acting on its behalf. If the Shop fails to remedy the deficiencies within a reasonable period of time agreed with the Customer, the Customer shall be entitled to assert his/her rights in accordance with the procedure provided for in the Civil Code.

6. Obligations of the Shop towards the goods:

6.1 The Shop undertakes to deliver the Goods in accordance with the information provided with each Good.

6.2 The Shop undertakes to provide the Customer with the quantity of goods specified in the order. The Shop shall not be liable in cases where the quantity of goods delivered is not accurate due to the Customer's incorrect indication of the data in the order submitted to the Shop.

6.3 In all cases, the Shop shall provide the Customer with a range of Goods that meets the criteria set out in the Order.

6.4 The Shop indicates the delivery time for each item, so the Customer should note the possible different delivery times before placing an order.

6.5 The Shop undertakes to provide all information relating to the product and its delivery, and to contact the Customer in the event that, due to circumstances beyond the Shop's control, it is not possible to carry out the order placed accordingly.

6.6 The Goods shall be delivered packed in a manner appropriate to their nature in order to ensure that the Goods are fit for their intended use.

V. Return of Goods

1. When buying at jusuparduotuve.lt, each buyer and the goods purchased by him/her of suitable quality shall be granted a 30-day return guarantee from the date of receipt of the goods.

2. To return an item of suitable quality:

    You must contact info@ekuva.lt. Goods will not be accepted for return without prior notice and agreement.
    Explain the reason and attach proof of purchase.
    The product must be unused, with the marking labels and in its original packaging, undamaged and in good condition.

3. Each product is covered by the supplier's guarantee against manufacturing defects and other defects not related to normal use and environmental influences. The duration of the guarantee for each product can be found in the description of the goods.

4. To return a faulty product, please follow the steps listed above.

5. The Shop undertakes to provide the consumer with a reasoned written reply within 10 days of receipt of the consumer's request.

VI. Payment procedure and terms

1. The Customer shall pay for the goods ordered in one of the following ways: by using his/her online bank or the mokejimai.lt system.

2. If the Customer has chosen one of the online payment methods, he/she undertakes to pay for the ordered goods immediately, otherwise he/she loses the right to claim for violation of the delivery deadlines, as the shipment of goods according to the Customer's order starts to be formed only after the Shop has received payment for the goods.

VII. Delivery of the Goods

1. The Shop undertakes to indicate the delivery period for each item. In the event of a delivery problem, the Shop undertakes to contact the Customer and find the best solution.

2. The Customer undertakes to take note of the delivery period indicated and to contact the Shop only if 24 hours have elapsed since the delivery period expired.

3. The Customer undertakes to specify the place of delivery and the person who will receive the goods when ordering the goods.

4. The Customer undertakes to collect the goods himself. In the event that the Customer is unable to accept the goods himself, and the goods have been delivered to the specified address and on the basis of other data provided by the Customer, the Customer shall not be entitled to claim against the Store for delivery of the goods to the wrong entity.

5. If the customer chooses to collect the goods from the company's headquarters at the time of ordering, he/she must present his/her identity document and a copy of the order. The Shop undertakes to call the Customer when the goods are ready.

6. Goods ordered in the Shop are delivered in three ways:

1) LP Express courier

2) LP Express post offices

3) Collection at the company's headquarters

8. In the event that the Customer notices upon receipt of the Goods that the parcel does not contain the correct Goods, the Customer must inform the Shop immediately.

VI. Other provisions

1. All notifications to the Shop must be made by e-mail to info@ekuva.lt.lt or by telephone +370 616 40002.

2. The Contract shall be concluded, performed and all communication between the Customer and the Shop shall be in the official language.

3. Please be informed that the account information and payment initiation services will be provided by Paysera in accordance with the terms and conditions of these services. By proceeding with the payment, you confirm that you accept the provision of these services and their terms and conditions.
